Report: Former AFL player files lawsuit

NEW YORK (AP) -A former Arena Football League player filed a lawsuit Wednesday alleging that a Colorado Crush team doctor mistreated his concussions two years ago, resulting in permanent injury, The New York Times reported on its Web site Thursday night.

Clay Rush was a kicker for the Crush in 2008 when he sustained a series of hits to the head over several games. The complaint says the hits were mishandled by a team physician, Dr. Saurabh Mangalik.

Court papers also name HealthONE Clinic Services, Mangalik's employer, as a co-defendant. The lawsuit was filed in state court in Denver.

Mangalik told The Times that his records indicated that he had repeatedly told Rush and team trainers that the kicker should not play or practice until his symptoms, such as headaches and dizziness, cleared.

Rush's lawsuit claims that Mangalik treated him only for a headache and ``failed to properly evaluate and observe'' him before allowing him to play.

A spokesman for HealthONE Clinic Services, based in Denver, told the newspaper that the company would not comment until it could review the court filing.

No Crush official is named in the lawsuit because Colorado law restricts legal action for injured employees to the state worker's compensation system. Mangalik and HealthONE were independently contracted by the Crush as medical providers and are therefore not considered Rush's employers, according to The Times.
