MASSACHUSETTS BETTING LAWS
Since 2017, MA has attempted to legalize mobile betting. The first push in recent Massachusetts history came from Massachusetts State Sen. Eileen Donoghue in January 2018, and while that didn't succeed, lawmakers continue to vie for a legal online betting bil.
MA had some difficulty getting their sports betting bills off the ground in the 2020s, but once Governor Charlie Baker issued his own proposal for legal sports betting in the Bay State, lawmakers hit the ground running. Now, in the middle of 2021, legislators have put sports betting revenue on the 2022 budget in addition to passing one house bill through the Ways and Means Committee.
The summer of 2021 saw a lot of action for potential sports betting in Massachusetts, with hearings and proposals happening on a weekly basis. Now that we're firmly ensconced in 2022, the House and Senate both continue to propose and amend sports betting bills, with licensed gaming operators and lawmakers alike pushing for a bill to help curb offshore sportsbook operators and capture revenue.
Two major names that you'll keep seeing: Senate President Karen Spilka continues to fight for a consensus among her colleagues as they try to advance a forward-thinking bill that brings in money for the state without ruffling too many feathers. Her counterpart, House Speaker Ronald Mariano, also wants sports betting, but has continued to push for collegiate bets to be included, as MA is home to a number of college teams.
BILLS ON THE TABLE / PREVIOUS VERSIONS OF
There are quite a few pieces of legal sports betting legislation attempting to make it on the charter and become Massachusetts law:
- H 3993: This heavily amended bill includes wagering on collegiate sports at a tax rate of 12.5-15% based on platform.
- S 2884: This Senate-sponsored bill does not allow for wagering on collegiate sports and proposes a much higher tax rate of 20-35% (retail versus mobile betting).
- H 3977: This became H 3993, but passed the MA House in 2021.
CASINO BETTING IN MA
There are a variety of betting opportunities legal in Massachusetts. Retail casinos are totally legal, but so far online casinos have not been legalized. Additionally, though horse betting is legal, sports betting is still not. Lottery and DFS are legal in the state and there are several available markets for fantasy gaming. Sports betting would be big business if it came to the Bay State, as the region is home to some of the most celebrated teams with some of the most voracious fans in the country.

As the situation stands in 2022, Massachusetts sports betting legislation is making steady progress. There are a few bills that have good support in the legislature, and one has already made its way past the Ways and Means Committee. This process of approval by Ways and Means has killed hundreds of potential laws, so it's a good sign that things are moving in the right direction.
