Kalshi, the federally regulated exchange, and its competitors are shaking up how U.S. traders predict real-world events.

Kalshi, which provides "Prediction Markets" on such real-world events such as sports, politics and pop culture is available in most states including large states like California, Nevada, New Jersey, Arizona, Maryland, Texas and New York with a series of "Yes" or "No" propositions in which users can purchase "contracts," on, similar to stocks on a stock exchange. Kalshi is NOT an illegal gambling platform, nor is it a legalized sports betting platform at all similar to a sportsbook. Kalshi, as an exchange, falls outside gambling laws in most states.

As a financial trading company, not a regulated sportsbook, Kalshi can operate in states that currently do not have legal online sports betting, including states like California.

About Kalshi

The company technically does not operate under California gambling laws. It operates under the Commodity Futures Trading Commission (CFTC), which regulates federal financial exchanges, not the state. Its presence has withstood recent court challenges from the Blue Lake Rancheria, Picayune Rancheria of the Chukchansi Indians, and Chicken Ranch Rancheria of Me-Wuk Indians in the Northern District.

Its regulatory body and Prediction markets model differ from a typical sportsbook, allowing Kalshi to offer California residents and U.S. citizens without a legal sports betting platform a chance to get in on the Prediction Markets action.

California residents and other Americans living in a state without sports betting platforms can have a stake in whether the Dodgers will win a 3rd straight World Series, whether LeBron James is playing his last season with the Lakers, or who will win next year's Super Bowl.

Additionally, Kalshi also boasts popular politics markets such as "Will Candidate X be elected U.S. president in 2028" or "Will Donald Trump seek a 3rd term as President," pop culture markets such as "Will Actor X win the Oscar for Best Actor" or "Actor X will become the next James Bond." Kalshi also offers coverage of economics, weather events, scientific developments, and even world news.

So, is Kalshi legal in California? The answer is YES. Under its Prediction Markets model, Kalshi can avoid being lumped in with sportsbooks, which are currently prohibited by law in California.

California's Indian Gaming Regulatory Act (IGRA) grants the state's tribes exclusive rights to all forms of legal sports betting on Indian Lands and throughout the Golden State. Those tribes that have casinos on tribal lands have yet to agree to legalize sports betting for their citizens. The situation is complicated and far from being rectified.

Enter in prediction market platforms such as Kalshi, which manages to avoid legal fights with the state's tribes over its exchange model. Because it is a federally regulated exchange by the CFTC, Kalshi avoids any state gaming jurisdiction. "Event Contracts," including "Sports Contracts," which Kalshi sells, are structured as federally regulated financial products, not wagers or gaming contracts.

Prediction Markets, Yes. Sports Betting, No.

Despite numerous petitions, attempts at ballot measures, and a push from some of the biggest sportsbooks, including FanDuel and DraftKings, there has been little movement toward legalizing the best sportsbooks to make California home.

Enter "Prediction Markets" or "Events Contracts," which operate outside of state rules and are mandated by the Federal Government Commodity Futures Trading Commission (CFTC), which oversees event contracts at the federal level. Kalshi does not offer "sports betting," "gaming," or anything that violates state law. It sells contracts on the outcomes of real-world events, including sports.

How does Kalshi work?

Kalshi's Prediction Markets, a CFTC-regulated event-contract exchange, allows users to purchase contracts on a range of real-world outcomes. Users purchase contracts with "Yes" or "No" outcomes for between $0.01 and $1.00. The more popular the pick, the more expensive it will be. The more chances you take, the bigger the risk, the cheaper the "stock" will be.

When that event settles, the winning side of the "Yes" or "No" contract receives $1.00. The losing side gets zero. But, like stocks, users can sell at any time to gain a small profit or cut losses.

The price of each event outcome fluctuates. The stock's price depends on implied probability, just as a stock relies on market mechanics, trends, newsworthy events, and even emotion.

With Kalshi's Prediction Markets, users aren't betting against the house; they are trading against each other.

How to Trade Responsibly on Kalshi California

Kalshi and other Prediction markets have blurred the lines regarding regulation in California and several other states across America. Many argue that Kalshi is just another sports gambling platform and that the company simply "packages sports betting as events contracts." In turn, it should be subject to regulatory scrutiny; the best sportsbooks endure in terms of security, verification, and the overall product they provide.

That said, Kalshi, in California, does have protections/security features in place for users. Customers must verify their age by providing an ID. The company follows strict, industry-standard Responsible Gambling measures for concerned users, including:

  • Deposit Limits
  • Personalized Funding Cap
  • Notifications
  • Trading Breaks
  • Self Exclusion (Voluntary Opt-Out)
  • Resource library for concerned users and their families, including links to Problem Gambling Help Lines

Kalshi offers its users respectable customer support, including Email Support at support@kalshi.com and an excellent Help Center on the site.
